Please read these Terms of Service (“Terms”) carefully. They govern your access to and use of https://kingpoppi.com, our signup form, communications with King Poppi LLC (“King Poppi,” “we,” “us,” or “our”), and your purchase and use of King Poppi products. By using the website, submitting our form, or purchasing our product, you agree to these Terms and our Privacy Policy.

1. Agreement to terms

These Terms form a binding agreement between you and King Poppi LLC. If you do not agree, do not use the website, submit the signup form, or use the product.

2. Eligibility

You must be at least 18 years old to use this website, submit our form, or purchase or use King Poppi. By using the site or product, you represent that you meet this requirement and have authority to enter into these Terms.

3. Website and signup form

  • The website is provided for informational, marketing, and communication purposes.
  • Submitting our signup form does not guarantee product availability, pricing, shipping timing, or that you will receive any particular communication frequency.
  • You agree to provide accurate information and not impersonate any person or entity.
  • We may refuse, suspend, or remove form submissions that appear fraudulent, abusive, or spam.
  • By submitting the form, you consent to our Privacy Policy and to being contacted at the email address you provide.

4. Purchases and Shopify

Online purchases are made through our Shopify store at https://king-poppi.myshopify.com. Shopify’s checkout terms, payment processing, shipping policies, return/refund policies, and privacy practices apply to those transactions in addition to these Terms.

We reserve the right to limit quantities, refuse orders, correct pricing errors, cancel orders before shipment, and change product descriptions, colors, availability, or pricing at any time without notice.

5. Product description and results

We strive to display our products accurately, but colors, images, and performance may vary based on device settings, lighting, bottle type, and use conditions. Marketing statements on the website are for promotional purposes. Results may vary.

6. Product directions and safety warnings

Adult use only. King Poppi is a popping bottle opener that launches bottle caps. Misuse can cause injury or property damage. You must read and follow all product directions and warnings included with the product and on product labeling before use.

By purchasing, owning, or using King Poppi, you acknowledge and agree that:

  • You have read, understand, and will follow the official product directions.
  • You will use the product only as intended for removing crown caps from appropriate bottles.
  • The product is not intended for bottles with screw-off caps.
  • You will not aim the opener, bottle, or launched cap at yourself or any other person.
  • You will point the front of King Poppi and the bottle cap away from you and other people before squeezing the handle.
  • You will keep the angle of King Poppi fixed relative to the bottle as described in the directions while operating it.
  • You are solely responsible for using the product in a safe environment and keeping it away from children.

7. Assumption of risk and release

You understand that use of King Poppi involves inherent risks, including flying bottle caps, sharp edges, broken glass, spilled liquids, and injury to people or damage to property. You voluntarily assume all risks associated with purchase, possession, and use of the product.

To the fullest extent permitted by law, you release King Poppi LLC and its owners, officers, employees, contractors, affiliates, and agents from claims, damages, losses, and liabilities arising out of or related to your use or misuse of the website or product, except where such release is prohibited by law.

8. Disclaimer of warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

EXCEPT FOR ANY WRITTEN LIMITED WARRANTY PROVIDED WITH THE PRODUCT ITSELF (IF ANY), THE PRODUCT IS SOLD WITHOUT EXPRESS WARRANTIES NOT ALREADY REQUIRED BY APPLICABLE LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KING POPPI LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, OR THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR THE PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Product liability disclaimer

By purchasing or using King Poppi, you agree and acknowledge that King Poppi LLC is not liable for any personal injury, bodily harm, death, property damage, bottle breakage, material damage, or any other unforeseen damages that may result from using the product, whether caused by product defect, user error, or otherwise, except where liability cannot be excluded under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless King Poppi LLC and its owners, officers, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the website or product.
  • Your violation of these Terms or applicable law.
  • Your violation of any third-party rights.
  • Information or content you submit to us.

12. Acceptable use

You agree not to:

  • Use the website for unlawful, harmful, fraudulent, or abusive purposes.
  • Attempt to gain unauthorized access to our systems or data.
  • Interfere with the operation or security of the website.
  • Scrape, harvest, or copy content except as allowed by law.
  • Upload malware, spam, or malicious code through forms or communications.
  • Misrepresent your identity or affiliation.

13. Intellectual property

All website content, trademarks, logos, product designs, text, graphics, images, videos, and other materials are owned by King Poppi LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit our content without prior written permission.

14. User submissions

If you send us messages, testimonials, photos, videos, ideas, or other content (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display those Submissions for business purposes such as marketing, support, and product improvement, unless we agree otherwise in writing. You represent that you own or control your Submissions and that they do not violate any third-party rights.

15. DMCA / copyright complaints

If you believe content on our website infringes your copyright, send a notice to clinton@kingpoppi.com including: (1) identification of the copyrighted work; (2) identification of the material claimed to be infringing; (3) your contact information; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that your notice is accurate; and (6) your physical or electronic signature.

16. Third-party links and services

The website may link to third-party websites or services, including Shopify and social media platforms. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

17. Termination

We may suspend or terminate access to the website or refuse communications at any time, with or without notice, for conduct we believe violates these Terms or is harmful to us or others. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Changes to these Terms

We may modify these Terms at any time by posting an updated version on this page and updating the “Last updated” date. Material changes may also be communicated where appropriate. Continued use of the website or product after changes become effective constitutes acceptance of the revised Terms.

19. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where U.S. federal law applies.

20. Dispute resolution

Before filing a claim, you agree to contact us at clinton@kingpoppi.com and attempt to resolve the dispute informally within thirty (30) days.

Except where prohibited by law, you and King Poppi LLC agree that any dispute arising out of or relating to these Terms, the website, or the product will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction and venue in those courts.

Class action waiver: To the fullest extent permitted by law, you and King Poppi agree that disputes will be resolved only on an individual basis and not as a class, collective, consolidated, or representative action.

21. Export and legal compliance

You agree to comply with all applicable export, import, and trade laws. You may not use or export the product in violation of U.S. or other applicable laws.

22. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, supply chain interruptions, internet failures, or government actions.

23. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any product labeling or written warranty provided with the product, constitute the entire agreement regarding the website and supersede prior understandings on that subject.

24. No waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

25. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
